Article 83(2) of the GDPR gives the supervisory authority wide latitude in deciding whether or not to impose a fine and in deciding on the amount of fine to impose it provides for factors that the supervisory authority shall give due consideration. All in all, it provides for eleven factors to consider before deciding on the quantum of fine. Since these factors deal with subjective criteria, subject to the maximum limit of 4% of the total worldwide annual turnover of the preceding year, the supervisory authority has a wide discretion in deciding what the amount should be.
