Trump's weaknesses are aplenty and seemingly laid bare for all to see. But many people like to play on the idea that Biden has relatively few (in terms of political strategy and competence) but as it turns out one of the biggest complaints I have with Biden showed up again..
That is the refusal to take packing the court off the table. Like Biden has done with banning fracking, so he knows he can take it off the table. He just chooses not to do that. It would be to his political advantage to do this since most Americans do not want it. The fact that he refuses to take it off the hich leads to the logical conclusion that he is likely to try to pack the court. And that would be a huge mistake.
Governments require legitimacy. Without it people will not follow the rules set forth by the government. Packing the courts will be seen as illegitimate. It will be seen as changing the rules of the game in ways that other actions are not. Yes the Republicans are hypocrites for nominating a Justice right now. But hypocrisy is baked into the system and we accept it. And nobody can seriously argue that if the Democrats were it the same position that they would not do the same thing. No as bad as what the Republicans are doing, and I have put myself on the record criticizing them for doing it, this is exponentially worse.
In a polarizing society we need a government that can be seen as legitimate by people of all political groups, even if they hate the government. They must feel that the people in government deserve to be there and have a right to do what they are doing. I admit that the Democrats have been guilty of not completely doing that during the Trump administration. But if Biden packs the courts and conservatives no longer see his administration as legit then I am scared to think what can happen. I really do not want to see dueling violent protests in cities in a way we have not seen before. I do not want to see massive civil disobedience and individuals trying to enforce second amendment solutions. I do not want to see some version of a second civil war. I honestly believe it can be that serious.
I am so pissed at both political parties that I do not have a favorite in the presidential election. But honestly I hope that if Biden wins, and I think he is highly likely to win, that the Republicans hold the Senate. At this point we need some divided government to prevent some excesses that will emerge from one party rule. We do not need a society where both sides try to get what they want by any means necessary. My fear is that we are heading towards that and the civil unrest that will come from that can change our society for the negative more than even the stupid virus.
Biden can end all of that. He can say that he will not court pack under any conditions. There are other things that the Democrats can do which will piss off Republicans but will not be seen as changing the rules. But this is a big one and a power grab that will not end well for the nation. Hopefully if he gets more pressure from the public to move away from court packing he will heed those warnings.
